Course objectives
This course is practical complement of the MP511Zk course. Its aim is to deepen the theoretical knowledge in the area of IP protection and to teach students how to apply IP laws in practice . The attention is paid to all basic forms of protection, namely: protection of creative work (copyright) protection of technical solutions (patent law and utility models), the protection of signs of services and products (trademark law), protection of the appearance of the product (design rights).
Learning outcomes
After the successful completion of this course the student should have the understanding of basic principles of intellectual property rights in practice and should be able to take the appropriate legal steps in the area of legal protection of intangible assets.
Syllabus
  • 1) Introductory Seminar
  • Introduction to system of intellectual property rights, basic principles of intellectual property rights, role of intellectual property law in global economy
  • 2) Copyright
  • the scope of the protection, copyrighted works, license agreements, case-law, case study
  • 3) Patents, Utility Models
  • Patent databases (search), patent applications, patents, litigation; registration of a utility models; application for invalidity of a utility models; case-law; case study
  • 4) Protected Signs and Designations of Origin
  • trademark databases (search), the registration of trade marks, objections/invalidity, administrative proceedings before the IPO, international and community protection; case-law; case study
  • 5) Design Protection
  • design datababses (search), application of industrial design; invalidity of industrial designs; community protection; case-law; case study
  • 6) Enforcement of Intellectual Property Rights
  • formulation of pleas, the application for injunctions; Act No. 191/1999 Coll. and 221/2006 Coll.; specific of enforcement of intellectual property rights online

Teaching methods
Course consists of interactive seminars, which enhances practical skills (search in databases, submitting the relevant applications, proposals for cancellation or invalidity, dispositions of intellectual property rights [transfer / licensing] etc.) Students are also expected to prepare their homework - mainly study of selected case-law. As a communication platform between teachers and students serves the interactive e-learning in MU Information System, published course materials, case law, and presentations.
