- Course objectives
- At the end of the course students will be able to understand of conditions of general clause of unfair competition; understand of legal aspects of commercial firm; differentiate the delusory and comparative advertising; to work with information on knowledge domain and commercial secret; make legal and ethical evaluation of choosen advertisings; acquire information of trade mark law, trade names law and origin; understand of legal protection of unfair competition; learn about actual judical decisions of the Czech Supreme Court and find it s problematic aspects; understand to european regulation of unfair competition.
- Learning outcomes
- After completing the course, the student will be able to critically analyze unfair competition in the context of current decision-making practice and European regulation.
- Syllabus
- 1. Introduction, concept of legal regulation of unfair competition. Subjects of legal relations of unfair competition with a focus on the competitor (state? municipality? association? supervisory authority?) dTest and its position in unfair competition. 2. Influencers (bloggers, youtubers, etc.) as interferers in unfair competition? 3. Guerrilla, buzz and ambush marketing. The average and particularly vulnerable consumer. 4. Amendments to Directive 2005/29 and the CTMD (in particular the prohibition of dual quality of goods). Quality labels and their legal aspects. 5. Are alternative taxi operators engaging in unfair competition? Advertising of food supplements. 6. The Czech Dream - film viewing, discussion. 7. Code of Ethics in Advertising vs. Advertising Regulation Act or soft law and hard law. Legal imperfections after recodification. 8. Subliminal advertising. Hidden advertising. Product placement. 9. Current issues of law against unfair competition + case law. 10. Practical problems of entitlement to reasonable compensation. Advertising and protection of the personality/good reputation of a legal person. Advertising and copyright law. 11. Non-commercial advertising. Example of defective advertisements in practice. 12. Other topical issues. Colloquium.
