- Course objectives
- This course deals with environmental law as a specific field of law, the content of the course is focused in particular on the legal regulation of public participation in the protection and creation of the environment and in decision-making about it. The aim of the course is to acquaint students with the activities of public administration bodies in the field of environmental protection and to acquaint them with the possibilities that active citizens have in controlling public administration in environmental issues. At the end of the course, students will be able to solve practical examples from the discussed area in such a way that they can apply the acquired knowledge in their future application practice.
- Learning outcomes
- At the end of this course, the student will be able to work with the general parts of environmental law, will be able to understand the nature and mission of the subject of environmental law in various areas, explain its functions, argue its justification and relationship to other branches of law and will be able to apply the tools of environmental protection in a broader context. In particular, the student will be able to: understand and explain the general principles of environmental law; understand the system of environmental law regulation; explain the main concepts of environmental law; solve selected problems in the field of environmental law by applying legal norms and case law; explain the importance of public participation in environmental protection; establish an environmental protection association; participate in environmental protection proceedings and formulate arguments for the solution of environmental problems.
- Syllabus
- 1. Organizational information. Introduction to environmental law. Subjects of environmental law. Organisation and forms of public administration activity in the field of the environment.
- 2. International legal obligations of the Czech Republic and constitutional enshrinement of the right to a favourable environment with regard to public participation.
- 3. Fundamentals of administrative procedural law and administrative justice with a focus on public participation.
- 4. The right to information (not only) about the environment with a focus on public participation.
- 5. Workshop - drafting a request for information (not only) on the environment and sending it to the competent state administration authority.
- 6. Strategical Environmental Assessment and Environmental Impact Assessment with a focus on public participation (SEA/EIA).
- 7. Environmental protection and processes under the Building Act - systematics.
- 8. Searching in public administration information systems - CENIA, cadastre of real estate, spatial planning documentation.
- 9. Public participation in spatial planning and subsequent judicial review.
- 10. Public participation in planning and construction decision-making and subsequent judicial review.
- 11. Responsibility in environmental law with a focus on public participation.
- 12. Workshop - I want to set up an environmental association, how to do it?

- Teaching methods
- The course is based on interactive forms of teaching, work with legal regulations and case studies, etc. Students are expected to prepare before each seminar. Part of the course is a workshop - to attend a meeting of a municipal (regional) council or to attend a court hearing, and to take minutes of this meeting.
- Assessment methods
- The course is concluded with an oral examination, during which students answer the examiner's questions from the course. The aim of the examination is mainly to verify the student's ability to solve practical examples from the given area.

- Please note that the course will be taught using interactive teaching methods and in a rather practical manner with an emphasis on "trying out" the tools of environmental law. Students will work together in small groups, presenting their outcomes, drafting legal submissions, etc. An example (short case study) will be assigned for each seminar, the homework of which is a prerequisite for participation in the seminar. Attendance at seminars and workshops is compulsory and a total of two unexcused absences will be tolerated.
