- Course objectives
- After successful passing of the subject Discretionary powers of the public administration the student: - knows the theoretical knowledge about discretionary powers as a important institute of the administrative law - is able to orientate himself in the theoretical and practical aspects of the implementation of administrative discretion, and differentiate it from indefinite concepts, - is able to explain the legislative and application basis of the discretionary powers - understands the substantial aspects of the judicial review of the discretionary powers of the administrative bodies - in specific situations (s)he is able to apply the general principles of European administrative law that influences the discretionary powers
- Learning outcomes
- At the end of this course, the student will be able to - understand the nature and mission of discretionary powers, or administrative discretion of the administrative authority, - orient themselves in their interpretation and application, based on general principles, and using case law, - respect the differences from the basis and use of indefinit terms, - perceive the specifics of this area of the competence of administrative authorities, including the area of administrative punishment, and the specifics of judicial review, - orient themselves in the solution of case studies, and perceive the importance of proper reasoning.
- Syllabus
- The term discretionary powers and administrative discretion. The term decision making and decision-making process. The process of development of the rule of law principle, or more precisely the principle of legality of public administration. The relation between the allegiance and freedom in public administration decision making. Administrative discretion in the administrative law regulation – application, types, identification. Boundaries of administrative discretion. Content of discretion – the relation to object of the law and competence. The term “public interest”. Discretion in the application process. The aspects of administrative discretion (principles). Review of decisions, which are based on the administrative discretion, including judicial review. Relevant judicature.

- Teaching methods
- Theoretical preparation, collective consultations supported by e-learning through an interactive curriculum, developing distance learning through study materials, selected case law, as well as test agendas providing feedback.
- Assessment methods
- A prerequisite for the colloquium is the preparation and defence of a seminar project. Its length is set at a minimum of 5 standard pages. The thesis will consist of an analysis of selected case law related to the chosen problem in the field of the exercise of discretionary powers, or an example of the legal regulation of the concrete case of administrative discretion, with the formulation of generalised findings or substantiated opinions. The selected topic will be presented orally in a colloquium. The student must be able to defend the thesis and respond to questions on the issue.
