Course objectives
The aim of the course is to deepen the knowledge acquired in previous studies in the field of setting and application of discretionary powers of administrative authorities in relevant areas or sectors of public administration, and in the forms of its exercise according to the focus of the dissertation topic. Furthermore, to provide the student with the necessary consultation to be able to write the part of the dissertation in which the issue of the legally foreseen and limited discretion of public administration, governed by the relevant principles, is addressed. It is also the aim to acquire such knowledge and knowledge that will allow to add to the dissertation the parts related to the area of public administration discretion and its limits.
Learning outcomes
After completing the course, the student will have a detailed knowledge of the material necessary for further study and research in the field of his/her dissertation and will be able to: - identify the areas of focus of the dissertation in which the discretionary power of the public administration is manifested and distinguish it from other concepts or legislative solutions, especially from vague concepts; - outline the current domestic and foreign trends in the field of the application of discretionary power and its judicial review in relation to the topic of the dissertation; - prepare a comprehensive part of the dissertation, where he/she will evaluate the setting, application and review of discretionary power in relation to the topic of the dissertation, inter alia. The exercise of the discretionary power, and the identification and operation of the principles that profile its content.
Syllabus
  • The specific focus of the course may vary depending on the topic of the dissertation. Therefore, the specific content will always be specified within the ISP in agreement between the guarantor and the student so that the content framework is directed towards writing a quality part of the dissertation in the parts related to the exercise of discretionary power of public administration. Evaluation of performance will be the responsibility of the guarantor who will award the grade. However, it is expected that the student will consult the material with other representatives of the disciplines and areas concerned. The curriculum may consist of e.g. the following areas: - the link between the topic of the dissertation and the exercise of discretion; - the impact of legal regulation on the setting of administrative discretion, its limits and principles; - the content of administrative discretion - the connection with the purpose of the law, and the purpose of the authority of the administrative authority in the area of the dissertation focus; - the operation of the principles governing the exercise of discretion by administrative authorities in the area of the dissertation, and their eventual application in the area of the dissertation. the operation of European principles of administrative law, the criteria of legality, correctness, fairness in the decision-making of administrative authorities; - judicial review of administrative discretion, the role and development of case law in the area of discretionary power in relation to the area of focus of the thesis; - etc.

Teaching methods
The basic teaching method is individual consultations, reading and seminars based on discussion on selected topics.
Assessment methods
The evaluation is assigned by the trainer based on the fulfilment of the pre-agreed content set out in the ISP. Usually, it will be on the one hand the elaboration of a comprehensive part of the dissertation dealing with the examined material from the point of view of administrative law in its relevant parts, or also from the point of view of administrative science.
