Course objectives
The aim of the course is to familiarize students with the issues of administrative procedural law in the necessary scope within the basic principles governing the procedural procedures of administrative authorities, procedural concepts and institutes, the regulation of administrative proceedings in its general regulation, with attention to the specifics of some special procedures, especially proceedings on offences, including the issue of decisions and means of appeal and review, and other procedural forms of public administration, as well as the issue of judicial review within administrative justice and administrative justice proceedings, and to equip students with certain skills and abilities to apply the acquired knowledge to problems of practice, including orientation in case law.
Learning outcomes
After successful passing of the subject Administrative procedural law the student:
- understands the position and relevance of the administrative procedural law in the system of the administrative law
- can apply the general principles of the activities of administrative bodies in the particular procedural forms of the activities of administrative bodies
- knows about particular procedural practices of administrative bodies, especially in administrative procedure
- is able to apply the provisions about the particular procedural procedures and the main procedural acts
- knows how to prepare a decision of an administrative authority and is familiar with its formalities, as well as initiatives and proposals for the application of administrative decision review schemes, including judicial review,
- is able to orientate himself in the relevant judicature and can use it for elaboration of specific submissions and legal opinions

  • Concept, essence, and mission of administrative procedural law, position of administrative procedural law in the system of administrative law.
  • Concept and types of administrative procedures, general and special regulation of procedural procedures.
  • Scope of the Administrative Procedure Code.
  • Concept and definition of administrative procedure, principles of administrative procedure.
  • Subjects of administrative proceedings, administrative authorities, acts of administrative authorities, parties to proceedings, rights, and obligations of parties to proceedings, time limits and time calculation, procedure before initiation of proceedings, initiation of proceedings, grounds for issuing a decision, evidence, preliminary issues, interim measures, interruption and discontinuance of proceedings, administrative decision, other forms of decision, legal force and enforceability of decision, defects of administrative decision, special types of proceedings under the Administrative Procedure Code,
  • protection against inaction,
  • appeal, dissent, review proceedings, reopening of proceedings and new decision in the case, satisfaction of a party after filing an action in the administrative justice system.
