Course objectives
The subject Labour Law II, designed for students of the Master's form of study in Law and Legal Science, aims to provide students with the basic institutes of labour law and develop their knowledge in practical contexts, following the subject matter covered in the subject Labour Law I, focusing in particular on the recognition of labour relations and their distinction from other legal relations, the basic principles of labour law, elements of employee protection, subjects of labour relations and their legal actions. In the course of the Labour Law II course, students should acquire the essential aspects of the legal regulation of individual labour relations in particular areas, as well as basic skills applicable in labour law practice. Thus, the course will guide students through the legal aspects of the employment relationship from its establishment to its termination, including issues related to changes in the employment relationship, remuneration of dependent work, working and rest periods, holidays, obstacles at work, the obligation to compensate for injury, etc. The course will also reflect the specifics of the legal regulation of flexible employment relationships, in particular those based on agreements on work performed outside the employment relationship.
Learning outcomes
At the end of the course, students will be able to describe and explain, among other things, the essential and optional elements of an employment contract, including the limits of their possible contractual anchoring, be able to apply the legal regulation of termination of employment in a complex context or explain the basic aspects of the legal regulation of working time, rest periods and obstacles at work, including the mechanism of compensation for lost earnings of the employee. The graduate of the course will also be able to distinguish and describe the rules for the provision of wages, salary and remuneration under an agreement, understand the basic aspects and limits of setting up a payroll system at the employer, as well as explain the system of travel allowances provided to employees when travelling in connection with the performance of dependent work. Last but not least, at the end of the course, the student will also be able to assess the employer's or employee's obligation to compensate for injury in individual cases and recognise occupational accidents and diseases.
